OAU's juridical advisor: Pan-African organization's charter does not provide for admission of non-sovereign entities

The charter of the Organization of African Unity (OAU) "does not include any provision on the admission of an entity that still aspires to sovereignty and independence in the frame of a referendum or that has not acceded yet to the status of an African independent and sovereign state," asserted the juridical advisor to the OAU.

The OAU juridical advisor's opinion came in response to a question posed by Senegalese Foreign Minister Jacques Baudin, during the OAU's 69th ministerial council held in Addis Ababa, Ethiopia, last March 22-23.

The OAU advisor was answering Baudin's question: "Is it possible that 'a state' which is involved in a referendum process be already considered as 'a state', according to the legal meaning of the term?"

During the 69th OAU ministerial meeting, the Senegalese official exacted that a juridical explanation be submitted to the heads of state along with the juridical advisor's opinion and the report on the debates.

The admission of the Sadr within the OAU in 1984 sparked the walk-out of founding member Morocco.

The OAU's 69th ministerial council of Addis Ababa decided to refer the issue of whether to expel or not the puppet republic from the pan-African organization to the next OAU summit to be hosted by Algeria July 12-14.
