Qathafi on enacting new laws in Libya

Libya's Leader Muammar al-Qathafi underlined that it is difficult to come up with good laws that are good.

A JANA report said today: al-Qathafi underlined that no one should be imprisoned unless one's private freedom constitutes a threat to freedom of others, ie public freedom, stressing that freedom is a very important thing and should not be deprived easily for the prison is depriving freedom of a human being and which when it is deprived heshe would only be left with the biological life.

He, pointing out the futility of the prison penalty in deterring against committing crimes as underlined by the continuation of prisons in the world for a long time. This came during the second dialogue with law and jurist professions this week on a draft proposal to amend the Libyan penal code which is to be submitted to the basic peoples congresses.

The leader stressed that when prisons are restricted that no one may be deprived of his her private freedom, only for the protection of public freedom, then the number of imprisoned people would be very limited, and no one's freedom may be subjected to deprivation.

The Leader explained that if the world look into the punishment issue from this perspective the number of prisoners would not be large cautioning that imprisonment should be viewed as an original punishment and as a pain to those subjected to it and not as a deterrence. He explained that restricting imprisonment punishment by subjecting it to a condition that punishment be only for those whose freedom pose a danger or spoil public freedom. I mean other cases to which this condition does not apply should be punished using other penalties such as fines and other consequent penalties such as deprivation of civil rights and social deploration He proposed the study of the possibility of promoting the consecutive penalty to the level of the original penalty and replace it.

Qathafi stressed the need to observe international agreements and treaties to which Libya is a party when laying down laws but in the same time acknowledging that the world is in crisis stumbling and fluctuating and has not changed and we are working to contribute to its change and presenting useful things to the world. Among the treaties and agreements protocols and treaties cited by the leader in this respect the Universal Declaration of Human Rights as per resolution 217 of the UN General Assembly in 1948 which the leader urged not to ignore and indeed to observe it when speaking about human rights besides a set of other treaties agreements and protocols. The leader however underlined that this declaration any how was neither respected nor enforced.

He touched on the International Court of Justice which system is a fundamental part of the UN charter nevertheless this system is not enforced nor the rules of this court is honoured by the dominant power in the world he said.
