New labor code enters into force

The new labor code adopted last July, and deemed by experts as "the most important legal text on Labor in Morocco since the promulgation of the first legislative text regulating the labor sector in 1957," entered into force this Tuesday.
The code provides Morocco with a balanced legislation that will attract investments and promote labor. It was established in conformity with international conventions related to the world of labor, unions' liberties and international charters concerning the basic rights of women and children.
The new text regulates the labor market and clearly defines relations between employers and employees.
The debate resulting from this code between the concerned parties evidences the importance of the code, particularly the debate on unions' liberties, means to settle collective disputes, dismissal compensation and labor contracts.
On the right to stage strike, the new text includes several positive points, including the need of a 10-day notice before the strike, the possibility to deliver already fabricated goods during the period of the strike and the guarantee of minimum services.
The Code also regulates the system of contracts of an undetermined period, of a determined period and temporary job contracts.
On abusive dismissal, the text gives the possibility to employees to have recourse to "pre-conciliation," which means either a reintegration in their job or to have a compensation for dismissal. The amount of this compensation has doubled compared to the previous legislation.
The Code includes provisions that project the setting up of medical services, security commissions and health protection at work.
The Code is not applicable on employees working with state-owned companies and establishments in addition to some other categories. It stipulates, nonetheless, that they should benefit of guarantees that are at least equivalent to those in the Labor Code.
