The US treat Saddam as a prisoner of war
Iraq-USA, Politics, 1/10/2004

The US administration announced officially that the former Iraqi president Saddam Hussein is a "prisoner of war," after more than one month of his detention.

An official at the US defense department said that the Pentagon was late in giving this status to Saddam Hussein because it is "uncommon to have a prisoner at this high level, and therefore we wanted to study the situation and its implications, carefully," before giving him this status, adding that Hussein is being held according to the Geneva agreements, and enjoys all stated rights.

Shafrez explained the reasons behind giving this status to Saddam Hussein by saying "basically, he was the commander of the armed forces in the former regime, and therefore he was a member in the military establishment, and he was detained, and this makes of him a war prisoner."
