Swiss lawyer sues Israel's army
Israel-Switzerland, Politics, 9/10/2003
The Swiss attorney Marcel Bosonnet said on September 5 that he filed a lawsuit against Israel, accusing four top Israeli military of committing war crimes against the Palestinian people.
The four Israeli military men accused of war crimes are Shaoul Mofaz, former Israeli chief of staff, Benyamin Ben Eliezer, former Israeli defense minister, Dourn Almough, chief of Israeli forces in Gaza Strip and Avi Dekhtar, chief of the Israeli security service.
Bosonnet's lawsuit was based on Article no. 9 of the Swiss military penal code and the 4th Geneva treaty for the safety of civilians under occupation.
The articles of the Swiss law state that perpetrators of war crimes against civilians can be judged under the Swiss law even if they were foreigners. Whereas the Geneva treaty stipulates that the safety of civilians are the responsibility of the occupation authorities.
