The legal reasons behind arresting al-Homsi

The following was issued by the press office of the Syrian ministry of the Interior: Member of the Syrian People's Assembly PA ( parliament) Mamoun al-Homsi has issued a statement dated August 7, 2001 and he circulated it inside the country and through the international news agencies.

After sides concerned in the country became to know about the content of the statement al-Homsi was summoned before the court in Damascus. After the Damascus' court got to know about the said statement it found out that it implies an attempt to change the constitution illegally and to prevent the authorities from carrying out its tasks stated in the law, as well as attempts to undermine national unity and defaming the state, resisting works of its establishments and insulting its legislative, executive and judicial authorities, according to items 291, 294, 307, 376 and 378 of the Syrian sanctions law.

In line with the authority of the civil attorney general to file the " public right" case, the attorney general asked the minister of justice to contact the speaker of the people's Assembly (PA) to take necessary measures to give it the licensing to pursue a case, legally, against al-Homsi.

The PA speaker agreed and then the attorney general filed the case against Mamoun al-Homsi before the investigation court, ( the judge) who brought, through the police, al-Homsi to the court.

Al-Homsi admitted before the investigation judge of releasing, and circulation of the said statement and then a note of arrest was issued against him, with all measures against him were taken within the course of enforced rules.

Worthy mentioning that Mamoun al-Homsi and according to the documents of the ministry of Finance, found out that he has been escaping payment of taxes accumulated on him for the directorate of finance in Tartous since many years, estimated at 45 million Syrian pounds, which are an income tax of imports and exports of cars for the years 1992- 1995. For several years the Tartous' directorate of finance asked him to pay his taxes and he has been escaping it.
