List of provisions Israel has yet to honor in its peace agreement with the Palestinians/ document

The negotiations affairs department of the Palestine government released lately a list of provisions and agreements that Israel has so far failed to implement from the set of peace agreements that were signed between the Palestinians and the Jewish state over the years. The letter, distributed by the department among journalists and foreign diplomats in the PNA area, said that important measures that are required to implement the agreements signed "have not been put into effect."
"As we resume the Permanent Status Negotiations, and in order to create a positive environment for those negotiations, the Israeli government must immediately cease all settlement activities and honor the agreements signed, because we believe that the continuation of positive developments and trust building between the two sides are essential to the revival of the peace process," said the letter.
It listed the following points:
1. The Israeli government must dissolve its administration and withdraw its military government from the West Bank. "After the inauguration of the Council, the Civil Administration in the West Bank will be dissolved and the Israeli military government shall be withdrawn."(Article 1. Provision 5- Interim-Agreement).
2. The Israeli government must not use the term "Judea and Samaria." The Agreements signed refer to the "territories" as "West Bank."
3. The Israeli government must recognize the territorial integrity of the West Bank and Gaza Strip as a single territorial unit. "The two sides view the West Bank and the Gaza Strip as a single territorial unit, the integrity and status of which will be preserved during the Interim Agreement," (Protocol concerning Civil Affairs, Annex XI, Interim Agreement)
4. The Israeli government must honor all the provisions of Annex III of the Interim Agreement, (Protocol concerning Civil Affairs, Annex III, Interim Agreement).
5. The Israeli government must implement the provision relating to the complete redeployment of Israeli forces and to the assumption of the responsibility of public order for Palestinians in Area "B," by the Palestinian Authority. "There will be a complete redeployment of Israeli forces from Area 'B.' Israeli will transfer to the council and the council will assume responsibility for public order for Palestinians Israeli shall have the overriding responsibility for security for the purpose of protecting Israelis ad confronting the threat of terrorism"(Article XIII- Security -provision 2, Interim Agreement). "The Palestinian police shall be responsible for handling public order incidents in which only Palestinians are involved." (Also provision-b-2, of Article XII- Interim Agreement)
6. The Israeli government must adhere to the agreement regarding movement of Palestine police in Area "B." "Three months after the compilation of redeployment from Area 'B,' the (District Coordination Offices) DCOs may decide that movement of Palestinian policemen from the police station in Area 'B' to Palestinian towns and villages in Area 'B' on roads that are used only by Palestinian traffic will take place after notifying the DCO"(Article XIII- Security -provision b-4, Interim Agreement).
7. The Israeli government must implement the further redeployment phases from the West Bank, including the third phase of the further redeployments. "The council Jurisdiction will extend gradually to cover West Bank and Gaza Strip territory except for the issues to be negotiated in the permanent status negotiations, through a series of redeployments of the Israeli military forces. The first phase of the redeployments of the Israeli military forces will cover populated areas in the West Bank cities, town, refugee camps and hamlets, as wet cut in Annex 1, and will be completed prior to the eve of the Palestinian elections i.e. 22 days before the day of the election. Further redeployments of Israeli military forces to specified military locations will commence immediately upon the inauguration of the council and will be effected in three phases, each to take place after an interval of six months, to be concluded no later than eighteen months from the date of the inauguration of the council" (Article XVII-Jurisdiction-provision"8," Interim Agreement).
8. The Israeli government must do its part in regards to the anti-incitement committee. "Israel and the council shall seek to foster mutual understanding and tolerance and shall accordingly abstain from incitement, including hostile propaganda against each other, without derogating from the principle of freedom of expression shall take legal measures to prevent such incitement by any organization groups or individuals within their jurisdiction"(Article XXII, provision 1, Interim Agreement).
9. The Israeli government must move forward on the issue of displaced Palestinians. "The continuing committee shall decide by agreement on the modalities of admission of persons displaced from the West -Bank and the Gaza-Strip in 1967, together with the necessary measures to prevent disruption and disorder."( Article XXVII-provision 2- Interim Agreement).
10. The Israeli government must honor the implementation of the agreement concerning the safe-passages of persons, vehicles and goods between the West Bank and the Gaza Strip. In accordance with the (Sharm El Sheikh Memorandum, Article"5").
11. The Israeli government refrain from initiating or taking any step that may change the status of West Bank and the Gaza Strip, and thus should cease all settlements activities in the West Bank including East Jerusalem and in the Gaza Strip. (Article XXXI-Final clauses-provision 7, Interim Agreement, Article 5, Wye River Memorandum, and Article 10, Sharm El Sheikh Memorandum).
12. The Israeli government should consider the transfer of the territorial jurisdiction of the Jeftlik area to the Palestinian council in the first phase of the further redeployment phases. "While the Jeftlik area will come under the functional and personal Jurisdiction of the Council in the first phase of redeployment, the area's transfer to the territorial Jurisdiction of the council will be considered by the Israeli side in the first phase of the further redeployments phases." (Article XXXI- final clauses, provision 14, Interim Agreement).
13. The Israeli government must respect and preserve the normal and smooth movement of people, vehicles and goods within the West Bank and between the West Bank and the Gaza Strip. "In order to maintain the territorial integrity of the West Bank and the Gaza Strip as a single territorial unit and to promote their economic growth and the demographic and geographical links between them, both sides shall implement the provision of this Annex, while respecting, and preserving without obstacles, normal and smooth movement of people, vehicles, and goods within the West Bank, and between the West Bank and the Gaza Strip (Article 1. Annex 1, provision"2," Interim Agreement).
14. The Israeli government must remove all forms of the closure imposed on the West Bank and the Gaza Strip, and must not undermine the importance of Palestinian development programs. "Any security arrangements and measures which become effective commensurate with the redeployment of the Israeli military forces will not undermine the importance, nor will they prejudice, the Palestinian development programs and projects for reconstruction, and development of the West Bank and the Gaza Strip as well as the moral and physical dignity of the Palestinian people in the West Bank and the Gaza Strip." (Article 1, Annex 1- provision "2," Interim Agreement).
15. The Israeli Government must respect the unity and integrity of the Palestinian people in the West Bank and the Gaza Strip, and that they are accountable to the Palestinian Authority only. "After the inauguration of the Palestinian council, the unity and integrity of the Palestinian people in the West Bank and Gaza Strip shall be maintained and respected. All Palestinian people residing in the West Bank and Gaza Strip will be accountable to Palestinian Council, unless otherwise provided in this Agreement," (Article 1, Annex 1- provision "4," Interim Agreement).
16. The Israeli government must respect the Agreement on Jewish Holy sites in areas under the Palestinian Authority's Jurisdiction. (Article V, Annex 1- provision " ," Interim Agreement).
17. The Israeli government must take note of the fact that Israeli-Palestinian joint patrols should have began their function on roads crossing A,B and C in West Bank. "Each D.C.O will be allowed within three months after the completion of the redeployment in its respective district, to decide that joint patrols will function on roads crossing areas A, B and C," (Article V, Annex 1- provision " ," Interim Agreement).
18. The Israeli government must implement the provision in respect to movement of the joint mobile units in area "B." "Joint Mobile Units will operate in Area B and will be led by the Israeli vehicle. Three such Joint Mobile Units shall be located at each D.C.O One will be on alert 24 hours a day. The two others will perform missions as directed by the D.C.O during day light hours," (Article V, Annex 1- provision 5-a, Interim Agreement).
19. The Israeli government must immediately stop all building activities in and around Rachel's Tomb area. (Article V, Annex 1- provision 7, Interim Agreement).
20. The Israeli government must implement the provision concerning the Mawasi Beach in the Gaza Strip (Article VI, Annex 1- provision C, Interim Agreement).
21. The Israeli government must honor the agreement on Hebron issues as specified in (Article 7, of the Sharm El Sheik Memorandum). Also the Israeli Government must refrain for expanding the buildings of the settlers in the old city of Hebron. (Hebron Protocol Article 11.a)
22. The Israeli government should have concluded with the Palestinian Authority arrangements concerning passage of privately-owned Palestinian vehicles on both Rafah and Allenby Bridge terminals. "Special arrangement will be agreed upon by the two sides regarding the passage of goods, buses, trucks and privately owned vehicles" (Article VIII, Annex 1- provision 6-a, Interim Agreement).
23. The Israeli government must take note that the Allenby Bridge will be open through out the year except on Yom Kippur. "The Allenby Bridge terminal will operate from Sunday through Thursday between the hours of 08:00 and 24:00 and on Friday and Saturday, between the hours of 08:00 and 15:00 except on Yom Kippur." (Article XIII, Annex 1- provision 6-c, Interim Agreement).
24. The Israeli government must relocate the Erez crossing point to a location within Israeli adjacent to the delimiting line. (Article 1X, Annex 1- provision 1.a, Interim Agreement).
25. The Israeli government must honor the agreement concerning the free and normal movement of peoples vehicles and goods in the West Bank, between cities, towns, villages and refugee camps, and that such movement shall not need to be affected through checkpoints or roadblocks. (Article 1V, Annex 1- provision 2.a, Interim Agreement).
26. The Israeli government must immediately enter negotiations with the Palestinian Authority to review the amended protocol on international passages (Article VIII, Annex 1- provision "D," page "54," and Appendix 5, Interim Agreement).
27. The Israeli government must refrain from imposing closures on the Sea of Gaza, (Article XIV, Annex 1, Interim Agreement).
28. The Israeli government must honor all the provisions of Annex IV, relating to legal matters, (Annex IV, Interim Agreement).
29. The Israeli government must not violate any of the provisions of the protocol on economic relations. It should be noted that the two sides must review the whole protocol on Economic Relations. The recommendation of the ad-hoc economic committee must be implemented no later than September 30, 1999. (Sharm El Sheik Memorandum, article 4,d).
30. The Israeli government must continue to honor the agreement regarding the release of prisoners and detainees (Annex VII, Interim Agreement), and (Article 3, of Sharm El Sheik Memorandum).
31. The Israeli government must honor its commitment to enlarge the size of the Jericho area.
The Israeli government must honor its commitment concerning the construction of Palestinian Airport in the West Bank.(Article XIII, Annex 1).
